The work of the Income Tax Department is not complete until and unless the tax demands which have been raised are collected and duly recovered Collection and recovery is a subject which is of importance mainly to the Income Tax department rather than to the assessees. Probably due to this, there is almost no publication on this subject from private publishers. Departmental publications have also been very few:
But from my own experience while working in the Income Tax Department, I have seen that while legal position is available to a considerable extent from those presently available books, a vast cloud of doubt, confusion and ignorance is looming large in their mind regarding many practical aspects. As a result, on many occasions they have been groping in the dark. This book is intended to fill this void.
I have incorporated in this book not only legal provisions of Recovery proceedings & Stay of demand and relevant ones of Income Tax Act, 1961 along with a large number of important case laws and circulars/ notifications on those provisions but also some other allied Acts. I have also incorporated the samples of application forms used by assessee as well as the departmental officers for collection & recovery.
The present book represents an impressive and judicious blending of the provisions of various Acts, judicial decisions, the Circulars & Instructions issued by the Department. The text is interspersed with interpretations, explanations and illustrations wherever felt necessary to help the readers to assimilate the provisions in a better way. Another feature of the book that readers may appreciate is the Summary section of each Chapter containing latest case law covered in that Chapter.
In preparing this book, I collected materials from numerous sources. But the most prominent and inspiring source is Shri Ashok Kumar Manchanda, IRS, (1976-Batch) who has been the guiding force and a constant source of inspiration in my life. I am indebted to all these sources and particularly Shri Ashok Kumar Manchanda Sir. I also express my thanks to Commercial Law Publishers (India) Pvt. Ltd. who reposed confidence in me and published this book. They have done a good job in making this book attractive, acceptable and useful.
I have taken care to add as well as change discussion in certain areas on the basis of feedback received from the readers and colleagues in various colleges. We are sure that the readers will appreciate this edition like the earlier ones and continue to give us an opportunity to serve them.
